Terms of Sales
Article L411-6 of the Commercial Code pstates that "any producer, service provider, wholesaler or importer is required to communicate its general conditions of sale to any purchaser of products or any applicant for the provision of services who requests them for a professional activity".
1. Designation
The company INSTITUT EVOLUTION designates a professional training organization, whose head office is located at 30 rue Franklin, 93120 La Courneuve.
INSTITUT EVOLUTION sets up and provides training in the Ile-de-France region and throughout the national territory, alone or in partnership.
In the following paragraphs, it is agreed to designate by:
- customer: any natural or legal person who registers or places an order for training with the company Organization name
- trainee: the natural person who participates in training.
- Terms of Sales: the general conditions of sale, detailed below.
- OPCO: approved skill operators responsible for collecting and managing the training effort of companies.
2. Purpose and scope
These General Conditions of Sale determine the conditions applicable to the training services provided by INSTITUT EVOLUTION on behalf of a client. Any training order with the company implies the customer's unreserved acceptance of these General Terms and Conditions of Sale. These conditions prevail over any other document of the customer, in particular over all general conditions of purchase.
3. Quote and certificate
For each training, INSTITUT EVOLUTION undertakes to provide an estimate to the customer. The latter is required to return to the company a completed copy, dated, signed and stamped, with the mention "Good for agreement". At the client's request, a certificate of attendance or end of training can be provided.
4. Prices and terms of payment
The prices of the courses are indicated in euros excluding taxes and are to be increased by VAT at the rate in force. Payment is to be made after performance of the service, upon receipt of the invoice, in cash. Payment of invoices can be made by bank transfer or cheque.
5. Support
If the customer benefits from financing by a Competence Operator (OPCO), he must submit a request for support before the start of the service. The client is required to provide the financing agreement upon registration. In the event that INSTITUT EVOLUTION does not receive support from the OPCO on the 1st day of the training, all training costs will be invoiced to the customer.
6. Conditions for postponing and canceling a training session
Cancellation of a training session is possible, provided you do so at least 10 calendar days before the scheduled day and time. Any cancellation must be notified by e-mail to contact@institutevolution.com. This deadline exceeded, the customer is required to pay a cancellation penalty, up to 50% of the initial total cost of the training.
The request for postponement of his participation in training can be made by the client, provided that he sends a written request to the training organization within 10 days before the date of the training.
In the event of non-performance of its obligations following a fortuitous event or a case of force majeure, the company INSTITUT ÉVOLUTION cannot be held liable with regard to its customers. They will be notified by email.
7. Training program
If he deems it necessary, the speaker can adapt and modify (in agreement with the participants) the contents of the training according to the group dynamics or the level of the participants. The contents of the programs appearing on the presentation sheets are thus provided for information purposes only.
8. Intellectual property and copyright
Training materials, whatever their form (paper, digital, electronic, etc.), are protected by intellectual property and copyright. Their reproduction, partial or total, cannot be carried out without the express agreement of the company. The customer agrees not to use, transmit or reproduce all or part of these documents for the organization or animation of training.
9. Data processing and freedoms
The personal information communicated by the customer to the company INSTITUT ÉVOLUTION is useful for the processing of the registration as well as for the constitution of a customer file for commercial prospecting.
According to the law “Informatique et Libertés” of January 6, 1978, the customer has the right to access, rectify and oppose personal data concerning him.
10. Applicable law and attribution of jurisdiction
These General Conditions of Sale are governed by French law. In the event of a dispute arising between INSTITUT ÉVOLUTION and the customer, the search for an amicable solution will be preferred. Otherwise, the case will be brought before the courts of Bobigny.
